DMCA Policy
Welcome to the Digital Millennium Copyright Act ("DMCA") Policy page for our In App Advertising Network. We are committed to respecting the intellectual property rights of others and expect our advertisers and partners to do the same. This policy outlines our procedures for addressing alleged copyright infringement occurring through our advertising platform and for submitting counter-notifications.
We comply with the provisions of the DMCA and will promptly respond to notices of alleged infringement that are compliant with the DMCA and other applicable laws. If you believe your copyrighted work has been used or displayed in an advertisement served through our network in a way that constitutes copyright infringement, please follow the instructions below to submit a DMCA notice.
Filing a DMCA Notice of Alleged Infringement
If you are a copyright owner or an agent thereof and believe that any content (such as ad creatives, images, videos, or text) served through our advertising network infringes upon your copyrights, you may submit a DMCA notice to our Designated Copyright Agent. Your notification must be in writing and must include substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. This might include, but is not limited to, the specific ad creative ID, ad campaign ID, the name of the app(s) where the ad appeared, a screenshot, or a specific URL if the ad is hosted elsewhere but served through our network.
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please note that incomplete or inaccurate notices may not receive a response. We encourage you to consult with legal counsel before filing a DMCA notice.
Filing a Counter-Notification
If you believe that your advertisement or content, which was removed or disabled as a result of a DMCA notice, is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification to our Designated Copyright Agent. Your counter-notification must be in writing and must include substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which our In App Advertising Network may be found, and that you will accept service of process from the person who provided the original notification of the alleged infringement.
Please note that if you submit a counter-notification, we may send a copy of it to the original complaining party. We encourage you to consult with legal counsel before filing a counter-notification.
